Why Do You Need to Sign This Waiver? 

At Dewey Beach Bonfires, safety is our top priority. While we take every precaution to create a fun and secure experience, bonfire events involve inherent risks, including open flames, changing weather conditions, and public beach environments.

This Liability Waiver ensures that participants understand and accept these risks, follow local regulations, and comply with safety guidelines. By signing, you acknowledge that you assume responsibility for your participation and agree to follow all local ordinances, including rules regarding alcohol consumption and noise limits.

To participate in a bonfire event, the group leader must complete and sign this form on behalf of all attendees. Minors under 14 must be accompanied by a legal guardian.

This Waiver and Release of Liability ('Waiver') is executed by the undersigned ('Participant') in favor of DBSS LLC, its owners, employees, affiliates, and agents (collectively, 'Company').
  1. ASSUMPTION OF RISK I, the undersigned, acknowledge that participating in a bonfire activity involves inherent risks, including but not limited to burns, fire hazards, smoke inhalation, respiratory irritation, trip-and-fall hazards, and weather-related risks. I voluntarily assume all such risks, whether known or unknown, and agree to participate at my own risk. Additionally, I understand that risks may arise from factors outside the control of DBSS LLC, including but not limited to:
  2. Disorderly or unruly behavior of other beachgoers, including intoxicated individuals.
  3. Sudden changes in weather, such as high winds, storms, tidal surges, flooding, or lightning.
  4. Potential wildlife encounters, including marine life (jellyfish, crabs, etc.) or other animals.
  5. Actions of third parties, including accidents or disturbances caused by non-participants.
  6. Equipment malfunction due to natural wear and tear or unforeseen conditions.
  7. Government or law enforcement actions, including beach closures or regulatory changes.
  8. RELEASE OF LIABILITY In consideration of being allowed to participate in the bonfire event, I hereby waive, release, and discharge DBSS LLC, its owners, employees, affiliates, and agents from any and all claims, liabilities, damages, or expenses, including injury, property damage, or wrongful death, whether caused by ordinary negligence or gross negligence, to the fullest extent permitted by law.
  9. INDEMNIFICATION I agree to indemnify, defend, and hold harmless DBSS LLC from any claims, lawsuits, liabilities, or expenses, including legal fees, arising from my participation in the bonfire event, except in cases of willful misconduct by DBSS LLC.
  10. SAFETY GUIDELINES AND EMERGENCY PROCEDURES I agree to follow all safety guidelines and staff instructions, including but not limited to: • Keeping a safe distance from the fire. • Avoiding handling flammable materials near the fire. • Ensuring children under 14 are supervised by a legal guardian. • Reporting any fire hazards or emergencies to staff immediately. Additionally, I acknowledge that I have reviewed the FAQ page at deweybeachbonfires.com and agree to comply with all local laws and ordinances, including but not limited to: • No alcohol consumption at the event. • Adherence to noise limitations and beach conduct regulations.
  11. GOVERNING LAW This Waiver shall be governed by and construed under the laws of the State of Delaware. Any disputes arising from this agreement shall be resolved exclusively in the courts of Delaware.
  12. ACKNOWLEDGMENT AND SIGNATURE By signing below, I acknowledge that I have read and fully understand this Waiver, and I voluntarily agree to its terms. I understand that I am giving up substantial legal rights by signing this document.
